Terms of Service
The working principles for engaging NEXCOD.
Services
NEXCOD provides strategy, design, engineering and related digital product services as described in an agreed proposal or statement of work.
Project scope
Each engagement is defined by an agreed scope, deliverables, assumptions and timeline. Changes may require a revised scope or fee.
Payments
Fees, deposits, milestones and payment dates are set out in the applicable proposal. Work may pause when invoices are overdue.
Client responsibilities
Clients provide timely feedback, access, materials and decisions reasonably required for the work. Delays may affect delivery dates.
Intellectual property
Upon receipt of full payment, rights to final commissioned deliverables transfer as described in the applicable agreement. NEXCOD retains rights to pre-existing tools, methods and know-how.
Confidentiality
Each party will use reasonable care to protect confidential information shared during an engagement.
Revisions
Included revision rounds are defined in the project scope. Additional revisions or changes outside scope may be billed separately.
Cancellation
Either party may cancel an engagement as described in the applicable agreement. Work completed and expenses incurred remain payable.
Warranties
Services are provided with reasonable skill and care. We do not guarantee a particular commercial, technical or performance outcome.
Limitation of liability
To the extent permitted by law, liability is limited to fees paid for the relevant services, excluding liability that cannot lawfully be limited.
Governing law
The governing law and venue for an engagement will be specified in the applicable agreement.
